When Saunders County Records Disagree

Nebraska Public Access Laws

A precise request should state the subject, date, place, agency, and exact document. Include a report, booking, citation, warrant, or case number when known. State whether an electronic or paper copy is sought and whether certification is needed. Since no local base fee or firm response time is published, ask for an estimate before staff begins chargeable work.
Restricted, Sealed & Expunged Records
Nebraska uses several remedies rather than one broad way to erase an old record. Under §29-3523, an arrest with no filed charge leaves ordinary public criminal history after one year. A completed diversion with no filing leaves after two years. Qualifying dismissals, acquittals, deferred judgments, and approved problem-solving-court outcomes leave ordinary public dissemination when the agency receives the notice or order. Justice agencies may still retain access.
A person who completed the sentence, probation, or fine may ask the sentencing court for a set-aside under §29-2264. The order has legal benefits but does not destroy the case history. True expungement is chiefly for an arrest caused by law-enforcement error and requires a District Court petition, service on the County Attorney, and clear and convincing proof. Pardoned cases and some qualifying trafficking-related cases have sealing routes. Juvenile sealing follows a separate body of law.
Verify relief twice. First, obtain the entered order from Saunders County Court or District Court. Then request an NSP review after the agencies have had time to process it. A blank public result can reflect a lawful restriction, a delay, a name mismatch, or the scope of that database. It does not prove that every government record was destroyed.
